The former president had started the procedures to access the benefit on December 6, when he was still in charge of the Executive Branch. The organization assured that the granting process complied with the formal times

The National Social Security Administration (ANSES) approved the procedure presented by former president Alberto Fernández to access the benefit of privileged retirement, an income to which all former leaders have access and which reaches a total amount of 7 million pesos . As explained by the organization, the granting process met the corresponding deadlines, amid strong criticism from the opposition who, for example, had already presented a formal claim to prevent the payment of the special pension.
As detailed by ANSES, on December 6 - when Fernández was still in charge of the Executive Branch - he began the procedures to access the lifetime retirement benefit for former presidents and vice presidents granted by Law 24.01. “In compliance with what is stipulated in said law, he processed the retirement and resolved it in the usual time (three months),” official sources clarified.

Last February, when it emerged that the former president had begun his administrative process to collect that special pension, the Buenos Aires legislator Graciela Ocaña presented a formal claim in the next few hours before the Anses so that the former head of state cannot receive that benefit. “ Enough of privileges! We are going to give elements to the ANSES with which it can deny the privileged retirement of Alberto Fernández , and we are going to do it using the DNU that he himself signed declaring the pension emergency to be able to steal the money from the retirees," Ocaña published in his personal social network account X at the time.

In her rationale, the Public Trust deputy had emphasized the difficult situation faced by retirees. In addition, she put forward formal arguments, among them, that she has to establish her residence in Argentina. “What the law that grants these privileged retirements establishes are two conditions. One is that you should not collect any other type of retirement, pension and benefits within the system. And, on the other hand, the other condition is that you must reside in Argentina . “Clearly we are attaching statements where she said that when she left the presidency she was going to reside in Madrid, which she has been doing since December 21,” she said.

The reference pointed to Alberto Fernández's alleged decision to live for a time in Spain, an issue that had generated another controversy in relation to whether he should guarantee the police custody that all former presidents have, but outside the country. In any case, the former president expressed himself on his social networks: “I clarify that it is not in my mind to settle outside of Argentina or have residence in another country. I worship my decency and I will not let them defame my honesty by showing me as privileged. I don't want to be accused of abusing privileges I never asked for and never had. I only abide by receiving the treatment that the rules determine.”

In another message from his networks, Ocaña estimated the value of the privilege retirement that the former president would receive. “We cannot allow Alberto Fernández to receive a pension of 7 million pesos . This is equivalent to 66 retirements ,” stressed the legislator, who promoted a collection of signatures through the Change.org platform .

“Retirees have been the big losers of the model that the Fernández presidency established. Retirees have spectacularly lost two points of the product with their loss of pension values. This is something that cannot be accepted,” the legislator insisted.

Ocaña repudiated that Alberto Fernández “dares to ask for a retirement for his management that has been disastrous with 130 thousand deaths from COVID-19, the Olivos party and the VIP vaccination center.” “The truth is that it is not surprising that Alberto is a scoundrel and has asked for this benefit. He has done it precisely in the days before Congress eliminates that law,” he concluded.
