The National Government ordered changes in the way of paying with cards with the aim of avoiding fraud.

Through Resolution 87/2024 , published this Tuesday in the Official Gazette , the Ministry of Commerce announced that “all commercial establishments that accept credit, purchase or debit cards for carrying out their commercial transactions under the terms of Article 1 ° of Law No. 25,065 and its modifications, and operate with electronic terminals for the payment of the operations carried out (data capture terminals or “POS”), they must make them available to the consumer in such a way that, in no case moment, lose control or be dispossessed of your card, not even momentarily, until the complete completion of the operation .

In effect, businesses will not be able to force customers to part with their plastic or ID card at any time , so they must check the information in front of them at all times.


In the recitals, the Executive Branch explained that the modifications are given with the objective of reducing fraud chaos, such as the cloning of plastics to make illegal purchases: “The reiteration of facts of computer fraud in the market is public and well-known. "consisting of capturing consumer data contained in their credit, purchase or debit cards, which are subsequently used to commit illicit acts, generating - in many cases - serious damage to the economic interests of consumers."


In this sense, “the fact that the consumer loses control over the use of his or her credit, purchase or debit card, or is dispossessed of it - even temporarily - when making a purchase or location of goods or services, has "given rise to the misappropriation of consumer data to commit acts of fraud," was added in the text of the secretariat that depends on the Ministry of Economy.

“The proper functioning of the market has as a fundamental pillar, among other things, that the goods provided in it have maximum security for consumers, in terms of their use and functionality,” the Government stressed.

“It is pertinent and necessary to establish criteria so that the consumer, regarding the use of their card, does not lose control of it at any time during the transaction, which will reduce the possibility of improper capture of their data, or its fraudulent use”, concluded the resolution that bears the signature of the Secretary of Commerce, Pablo Lavigne .

The measure was prepared by the Undersecretary of Consumer Defense and Commercial Loyalty, Fernando Blanco Muiño . To implement the changes, an adaptation period of 180 days was established from their entry into force, so that suppliers adapt customer service services in accordance with the provisions of this resolution.

It is important that users frequently review their transactions and their available balance to check that they have not fallen into any type of fraud. This can be done through the home banking of the bank to which the card belongs. It is advisable to always do it from a secure Wi Fi network.

If you detect any type of unusual movement on your cards or if the consumer directly realizes that he or she was the victim of a crime, it is recommended to contact the bank that issued the plastic and request that the card be blocked; report fraud; and request the return of the stolen money.

 
I laughed when I read only 7,000 complaints were received for the entire year. I can't imagine what the # must be for the USA. I have never found credit card fraud to be problem in Argentina but I am all for positive changes for the consumer.
