As of January 1, 2025, an important change in the Stamp Tax for the purchase and sale of properties in the City of Buenos Aires came into effect. The exempt amount for single-family and permanent-occupancy housing transactions increases significantly, from $56,270,730 to $205,332,000 (approximately US$200,000). This means that those who acquire properties within this range and meet the requirements will not have to pay the 3.5% corresponding to this tax , which represents an important economic relief and an incentive for the acquisition of one's own home.

Buyers will be able to save paying 3.5% on the value of the property by meeting the requirements established for the Stamp Duty exemption

This change was established by laws 6805 and 6806 , which modify the Tax Code and the Tariff Law for 2025, and published in the Official Gazette of the City of Buenos Aires.

What is Stamp Duty and how is it applied?

The Stamp Tax is levied on all real estate purchase and sale transactions in the City of Buenos Aires. Currently, this tax corresponds to 3.5% of the value of the property's title deed. By custom, it is usually divided equally between the parties involved: the buyer pays 1.75% and the seller 1.75%.



However, for transactions that qualify as single-family, permanent-occupancy housing, the new exempt amount will allow those who buy properties with a deed price of less than $205,332,000 to not have to pay this tax.

In the event that the property price is higher and there is no exemption, both parties pay the tax in equal parts. For example, for a property worth $300,000,000, or if the buyer already has another home or property (such as a garage), he or she must pay 3.5% of the total transaction, divided between the buyer and the seller.

Impact on the real estate market

Fabián Achával, CEO of Fabián Achával Propiedades, told LA NACION that this measure will have a positive effect on sales operations: “It is excellent news. This will basically have an impact on the transactional cost, both for the seller and the buyer, especially for single-family homes, to drop significantly. And by raising the limit, many properties that already paid this tax will now stop paying it.”

As an example: a property that is sold from now on for US$190,000 will no longer pay the 3.5% tax, which would be US$6,650, to be paid in equal parts US$3,325 by the buyer and US$3,325 by the seller.

Achával also explained that this reduction in transaction costs could help close more deals : “Many times a deal falls through due to a very small difference in price. This relieves both parties and allows more deals to be closed.”

For real estate market analyst Daniel Bryn, the impact of the measure is highly positive. “It considerably raises the threshold, going from the previous US$50,000 to the current US$200,000. This reduces the transactional cost of the properties, which is usually high due to the sum of the fees of the real estate agencies, notaries, stamp duties and other associated expenses. This is excellent news, as it facilitates operations by lowering the costs of buying, selling, reselling or even exchanging,” he stated to LA NACION .

Jorge De Bártolo, president of the College of Notaries of the City of Buenos Aires, explained that the measure will be of great help to buyers, especially to the average public, who usually have tight budgets for a purchase. “This includes what they have to pay to the real estate agency, the transaction costs, the costs to the seller and the taxes withheld by the notary, such as the Stamp Tax.” According to De Bártolo, with the base of $205,332,000, those who buy a first home in the City for less than that amount will not pay the stamp tax, which represents a significant reduction in expenses.

De Bártolo explained that the agency had requested an adjustment in two key aspects. “With the previous administration of Horacio Rodríguez Larreta and the current one of Jorge Macri, we requested, first of all, an increase in the base of the Stamp Tax exemption, which pleasantly surprised us, since they implemented it, and it is a significant improvement. Secondly, we requested a reduction in the rate , but this point was not modified,” said the notary, who stressed that the rate in the city of Buenos Aires, 3.5%, remains the highest in the country , compared to the 2% paid in the Province of Buenos Aires.

Requirements for accessing the exemption

For a transaction to be exempt from Stamp Duty, it must meet the following requirements:



  • The buyer must not own another property in the city of Buenos Aires at the time of acquisition.
  • The dwelling must be intended exclusively for single, family use and permanent occupation.
  • The value of the deed must not exceed $205,332,000.


Failure to comply with these conditions will result in a 3.5% tax being applied to the total value of the transaction.



Tax payment procedure

Stamp duty is payable at the time of signing the deed of transfer of ownership, in equal parts between the buyer and the seller. The notary involved acts as a withholding agent and is responsible for including this amount in the budget prepared for the transaction. Therefore, it is essential that buyers consult with their notary to confirm whether they meet the exemption requirements.
