Despite the elusive luck that the Government had in Congress with its initiatives, President Javier Milei instructed the Minister of Justice, Mariano Cúneo Libarona , to move forward decisively in the drafting and subsequent presentation in the Chamber of Deputies of a bill of law to reform the juvenile penal regime that has among its main provisions the lowering of the age of imputability to 14 years and the creation of a system to contain and resocialize those minors who receive a sentence.


Official sources confirmed to Infobae that the official and his team of advisors were working the extra long weekend to move forward with the decision made by the head of state to establish a new regulatory framework to face cases like the one that occurred two weeks ago in Rosario. , where the crime of beach player Bruno Bussanich could go unpunished because the perpetrator of the murder is 15 years old and therefore exempt from criminal responsibility.

Although at the beginning of the Easter break and the tribute to the veterans and fallen in the Malvinas war it had been announced that the text of the project was going to be presented this week, it was not ruled out among Cúneo Libarona collaborators that the next week. “The president's request is that it be presented as soon as possible and that will be done, but it is a very sensitive project that must be presented very rigorously,” they explained to Infobae .


In addition to the head of the Justice portfolio, the Minister of Security, Patricia Bullrich, works on the initiative, who together with the president were the first to react vehemently when the arrest of the alleged murderer of the beachgoer became known. The PRO leader, in fact, was part of Mauricio Macri's government, which also had among its priorities in 2017 a reform of the juvenile penal regime, which was never even brought to Congress. That initiative, the last one promoted by a Government, established reducing the age of punishment from 16 to 15 and established a series of gradations according to the type of seriousness of the crime committed.

In the case of the proposal that Cúneo Libarona is working on, which will collect the texts of more than 30 proposals that were presented in recent years, the system will establish a minimum floor of 14 years to be criminally responsible. But the main focus that the Minister of Justice placed is the creation of institutions and treatments that can promote the resocialization of minors in conflict with the law.

“The age is 14 years old and for all crimes. That is what almost the 30 projects that I have on my desk maintain, which have been presented and have not received legislative approval. Whether it is theft, robbery or abuse, the boy already demonstrates a personality that deserves attention and punishment ,” the official explained at the beginning of January. The lowering of the age of imputability and the creation of a criminal regime for minors was one of the priorities that the official raised since he arrived at the Government.

The new Minority Law would contemplate the implementation of a procedural system with specific characteristics for minors. “There must be a specialized court, with assistance and defense for minors, protective care for the accused and the victim, and it must have a much faster system than the trial of adults,” the Minister of Justice had explained. But the issue that Cúneo Libarona, according to him, focused on in recent days was the one linked to what to do with the teenager who ends up with a conviction for a serious crime.

For the Minister of Justice, "it is no use going to a prison where there is capacity for 200 children, but 350 are housed, because they leave worse than when they entered and then go to the regime for adults." When the urgency for the arrest of Rosario's case had not arisen, the official spoke about the need to establish institutions that have the mission of "reeducation, resocialization, obligation to study and work." These are objectives that are maintained in the drafting of the project that will be presented shortly in Deputies.

Although the Government knows that the National Congress is gripped by internal issues and pending accounts due to the failed debate on the “Omnibus Law”, it is confident that it can form a majority willing to discuss this initiative. Although in La Libertad Avanza they discount that the majority sector of Unión por la Patria and the left are going to refuse to change the current system that leaves cases like Rosario unpunished, they trust in establishing agreements with the PRO, the UCR, We Make the Federal Coalition and the provincial parties. “ Who is going to be in favor of impunity? ”, asked one of the promoters of the reform.
