The presidential spokesperson confirmed that the Government is evaluating declaring education as an essential service
The national government confirmed today that it is considering declaring education as an essential service, something that was included in the Decree of Necessity and Urgency 70/2023 that President Javier Milei signed a few days after taking office, but which was suspended by Justice.
“The decision has been made to begin the evaluation to declare education an essential service,” said presidential spokesperson Manuel Adorni today during his regular press conference, without giving further details.
DNU 70/2023 had modified Argentine labor law and had included education as an “essential service”, which limited the right to strike.
Article 97 of this regulation establishes that initial, primary and secondary education , as well as childcare services and special education, will be considered an “ essential service ”, among others . The measure has been discussed in the past as a mechanism to guarantee the right to education in the face of the prolongation of forceful measures, especially in some provinces that have had very long teaching conflicts in recent years, but it also generates strong resistance because limits the right to strike .
Milei's decision implies a restriction on teaching strikes : it establishes that, in the event of a collective conflict that affects services considered essential, in no case can the parties be “negotiated or imposed coverage of less than seventy-five percent (75 %) of the normal provision of the service in question.” That is to say: in a school, for example, no more than 1 in 4 teachers will be able to adhere to a force measure.
The DNU modifies article 24 of Law No. 25,877 of the Argentine labor regime, which until now only considered health and hospital services, the production and distribution of drinking water, electricity and gas, and air traffic control as essential. Argentine law establishes that “when, due to a labor conflict, any of the parties decides to adopt legitimate measures of direct action that involve activities that may be considered essential services, they must guarantee the provision of minimum services to avoid their interruption.”

However, the Justice declared that section of the DNU unconstitutional after a presentation by the CGT, so it is not in force. At the end of January, the Fair Room of the Chamber of Labor resolved the protection raised by the CGT and determined that chapter 4 of DNU 70/2023 by Javier Milei is unconstitutional. They argued that these types of reforms should be analyzed and debated in Congress. The decision covers articles linked to the labor reform promoted by the national government. The ruling, which Infobae accessed, was signed by judges Manuel Diez Selva, Héctor Guisado and Mario Fera, who - in this way - rejected the appeal that the Executive had made to leave the decree standing in its work section. It is assumed that the Government will appeal through an extraordinary appeal before the Supreme Court.
“There was no impediment to the meeting of the chambers of Congress, and even on December 27, 2023, that is, prior to the date of entry into force of DNU 70/2023, the legislative body was convened, in office. , and with powers to examine the content of the reforms promoted in said DNU,” the ruling stated.
The CGT claimed the unconstitutionality of the labor reform established by the decree in the last week of 2023, within the framework of a mobilization it made to the Palace of Courts. At that time, labor judge José Ignacio Ramonet refused to grant an “interim precautionary measure” against the DNU for the sole reason that at that time it had not come into force, but he declared himself competent, giving the State three days to to answer the protection and even detailed who the authorities of his jurisdiction were in January to request the authorization of the fair, in a clear sign of trying to resolve quickly.
“Argentina gets ahead by working and the problems that Argentina has today are 100% inherited from a policy that has destroyed Argentina. “We respect all measures of force and any type of demonstration, the unions are among those whom we respect as such, even though it is difficult for us to understand why there is so much viciousness with a Government that has only been in office for a few weeks ,” said Adorni. .
“A good part of Argentines understand that the disaster we have inherited has been enormous. Within the framework of respecting that there are people who do not think like us and perhaps are against what we are doing, in this context of Argentina, and in addition to a lot of people who need to get to work and earn a living, It seems like absolute nonsense to you ,” he added.
Adorni also spoke about the invasion of mosquitoes that some localities of the AMBA suffer , and had a particular view: according to the official, the responsibility for what happens lies with the Government of Alberto Fernández.
“We do not want to lose sight of the fact that a large part of this problem is due to the responsibility that was had in the failure or in the prevention policies that have been implemented during the past year . The task of prevention and dissemination of what dengue is was not well implemented. Many boasted of having achieved that Health is a ministry, we remember the song 'we have a ministry'. However, in management, the ministry was evidently conspicuous by its absence. Beyond climatic factors, mosquitoes have a cycle and actions to send breeding sites have to occur in advance,” Adorni explained.

Adorni questioned the train strike and blamed the Government of Alberto Fernández for the invasion of mosquitoes
Among other things, during his usual press conference held at the Casa Rosada, the presidential spokesperson was consulted about the train strike that the La Fraternidad union will carry out this Wednesday.“Argentina gets ahead by working and the problems that Argentina has today are 100% inherited from a policy that has destroyed Argentina. “We respect all measures of force and any type of demonstration, the unions are among those whom we respect as such, even though it is difficult for us to understand why there is so much viciousness with a Government that has only been in office for a few weeks ,” said Adorni. .
