The regulation of the deregulation of Social Works highlights the priority it represents for the current administration

Finally, the Government established regulations to deregulate social works , something that will reach more than 14 million workers who are dependent on both the public and private sectors, unionized, monotributists, domestic employees, and the more than 5 million people who belong to the so-called general system.

The Superintendency of Health Services (SSS) is the State agency that will lead this process of change whose central purpose is to give freedom of choice to beneficiaries and promote free competition between social and prepaid works.
“This decree will come into force on the first day of the month following that of its publication in the Official Gazette
,” indicates the text of the rule, this implies that the deregulation will begin to come into force on the first day of March.

In this way, through decree 170/2024 , the Executive made this modification official by establishing: “The right to free choice may be exercised by the affiliates who are holders of the Health Insurance Agents included in article 1 of the Law. No. 23,660, among any of the entities included in said rule, with the exception provided for in article 9.”

This right may be exercised for the period determined by the Enforcement Authority. The rule also specifies: “The minimum period of permanence will not be applicable for those beneficiaries who, being affiliated with a Health Insurance Agent, have chosen a Prepaid Medicine Entity as the provider of their medical coverage and this is registered in the Records established in section b) of article 5 of Law No. 26,682 and in article 6 of Law No. 23,660. In the latter case, they may exercise the right to free choice towards that same Prepaid Medicine Entity.”

The regulation of the deregulation of social works makes it evident that for the administration of President Javier Milei the issue had priority status. Not only because it was incorporated into DNU 70/23 and did not suffer the delays that other measures had, but also because the ordering and transparency of the contributions and contributions that the State makes to the health sector represents attacking the concept of “ “black boxes” that so obsess the President.

What are the main changes introduced by this decision?​

Official sources explained to Infobae that the deregulation of social works introduces the following five substantial changes for the Health sector:

  • Beneficiaries will be able to freely choose between social and prepaid works.
  • Beneficiaries will no longer have to spend a year in the social work of their activity when entering a new job.
  • Beneficiaries will be able to choose a social or prepaid work - which is registered for this purpose - when starting a new job , without any type of intermediation.
  • Beneficiaries may exercise the right of free choice once a year, at any time from the beginning of the employment relationship.
  • Prepaid medicine companies are obliged to contribute to the Solidarity Redistribution Fund for the total amount they receive (approximately 20%).

The possibility for workers to choose between a social work or a prepaid one, eliminates previous restrictions

The Superintendency of Health Services (SSS), in addition to driving the changes, will supervise contributions and contributions to social and prepaid works. The money goes directly from the AFIP, through the sworn declaration of the employers or the direct payment of the monotributista, directly to the union social works (OOSS), less what is sent to the Solidarity Redistribution Fund that is made up of 10 % monotributistas, 15% Union social works and 20% in the case of prepaid medicine companies.

As Infobae was able to confirm , the vocation of the Health and Government portfolio is not to dismantle contributions and contributions that the SSS executes until now, but to optimize the circulation of money between prepaid companies, social works and beneficiaries of the social security system; and that this money reaches the system and does not stagnate in providers that have been created as empty entities, distribution belts or rubber stamps that receive contributions and contributions, and do not provide any service.

The SSS worked to reach the regulation of the deregulation of social and prepaid works on two governing laws - one old and one new - on which the changes for the health sector in Argentina are mounted. The objective is to give freedom of choice to beneficiaries and promote free competition between social and prepaid works.

Thus, the SSS created a new, more realistic figure: the Prepaid Medicine Entities to later add it to the list contemplated by Law 23,660 , allowing the worker to directly choose a social work or prepaid medicine company.

With this, the creation of the Prepaid Medicine Entities is made official

In reference to health benefits, the entities will be part of the National Health Insurance System and will allocate their resources as a priority to these benefits. And it establishes as beneficiaries of the entities the workers who provide services in a dependency relationship , whether in the private sphere or in the public sector, and national retirees and pensioners.

When entities receive contributions in addition to the sum of the contribution and contributions, they must deposit 20% to the Solidarity Redistribution Fund. All this was made official this morning through decree 171/2024.

The other regulation on which the Superintendency of Health Services (SSS) worked to reach the regulation of social works is Law No. 23,661 on the National Health Insurance System, under which insurance agents are considered to be national social works , whatever their nature or name, the social works of other jurisdictions, the prepaid medicine companies and other entities that adhere to the system that is established, which must adapt their health benefits to the standards that are dictated and approved. They will be governed by the provisions of this law, its regulations and the social works law.
