The Buenos Aires Legislature voted in its first reading to firmly protect iconic buildings. After the complete modification of the Urban Planning Code was completed before the end of the year, they will obtain definitive heritage protection.

The Buenos Aires Legislature debated the definitive heritage protection of 4,353 buildings distributed in different neighborhoods of the city of Buenos Aires. Several of these buildings were built before 1941 and currently have preventive protection, but with the modification of the Urban Planning Code (CUR) they will have a definitive protection.



Among the buildings highlighted are the City Park Tower, the Basilica of San José de Flores, the Libertad Palace, the Oscar and Juan Gálvez Racetrack arch, and the Spinetto Market. Several hospitals and train stations were also included, as well as housing complexes such as La Mansión de Flores , which are part of a list of buildings proposed to receive this status and ensure their preservation as part of the urban heritage. Boca Juniors' La Bombonera was excluded from the list of historic buildings and may be remodeled as reported by Infobae . The River Plate and Huracán stadiums were also excluded.

The aim of this measure is to ensure that these emblematic buildings, which form part of the city's historical and cultural landscape, maintain their architectural value and identity in the face of future urban developments.

The century-old Mansion de Flores, built by architect Fermín Bereterbide, is an example of efficiency in collective housing in the western area of CABA. Opened in 1924 and located between Yerbal, Caracas, Gavilán and the Sarmiento Railway tracks, the complex currently has units for sale.

Once the law is approved, these properties will have definitive heritage protection. There are several legislative steps to take beforehand; yesterday the first reading of this catalogue was approved. After this initial vote, there will be a public hearing and, subsequently, a second reading to finalize the process and grant definitive legal protection to the selected properties before the end of the year.

The path

The legislation on heritage protection in CABA establishes that buildings built before 1941 must undergo an evaluation process to receive provisional protection.



These properties were included in a preventive catalogue that determines their level of protection, which can be precautionary, structural or integral, as defined by the Advisory Council on Heritage Affairs (CAAP). This independent body, made up of experts in architecture, history and culture, is in charge of evaluating the historical and architectural value of each property.

The process that will be carried out in the Buenos Aires Legislature seeks to convert this provisional protection into a permanent one. “Currently, several properties are in a kind of legal limbo , since, although they are classified preventively, they do not have permanent legal protection. For this to happen, they must go through legislative treatment, where their final destination will be decided: maintain the protection, adjust it or, in some cases, dismiss it if they do not meet the necessary criteria,” a source from the Buenos Aires Urban Development Secretariat acknowledged to Infobae .

Once a property is classified as a preventive measure, the owners are notified and have the possibility to appeal the decision if they do not agree with the categorization. This usually occurs when the owners see limited possibilities of developing the land, since the protection may prevent the demolition or significant remodeling of the building.

However, an owner who wishes to make repairs or modifications to his protected property can request authorization from the corresponding Buenos Aires City Government agency or the CAPP. With a valid argument and as long as the proposed modifications do not harm the heritage or historical value of the building, the changes could be carried out. As long as this process is respected and the necessary approval is obtained, there would be no problems in moving forward with the works.

Some of the buildings

Basilica of San José de Flores (integral protection): Neoclassical in style, this imposing building is located at 6950 Rivadavia Avenue, in Commune 7. Its structure dates back to 1883, with modifications in 1915. The architects who designed it were the Italians Benito Panunzi and Emilio Lombardo.

Libertad Palace (structural protection): The former Post Office and Telecommunications Palace is in keeping with the stylistic movement of French academicism. It was designed by the French architect Norbert Maillart in 1888. The building was modified on several occasions: 1904, 1911, 1939, 1993 and 2010.

The Parque de la Ciudad Space Tower (structural protection): Located in Villa Soldati, it reaches a height of 208 meters and can be seen from different points in the city and the province of Buenos Aires. The work belongs to the designer Richard Battaglia and the construction was carried out by the Waagner-Biro company of Austria. It was inaugurated in 1980 and remains closed to the public.

Access arch to the Juan and Oscar Gálvez racetrack (integral protection): The 1952 construction located at the entrance on Roca Avenue 6902 corresponds to the modern movement. The emblematic arch encloses twelve posts and begins on one of the sides where an obelisk of more than 50 meters rises.

Spinetto Market (precautionary protection): Located between Alsina, Moreno, Pichincha and Matheu streets in the Balvanera neighborhood; the 1890 market features a construction designed by architect Juan Antonio Buschiazzo.

The Spinetto Market was also the former Buenos Aires City Market in the Balvanera neighborhood.

Julio Méndez Sanatorium (precautionary protection): The pavilion-style hospital is located in the Caballito neighborhood. It was designed in 1958 by architects Hilario Lorenzutti and AM Cervini.

La Botica del Ángel (integral protection): Built in 1951 on Luis Sáenz Peña 541/543, in the Monserrat neighborhood. Its author is unknown and its current use is as an Independent Theater and Culture Club.

Former ventilation chimneys (integral protection): Built between 1880 and 1920, both structures are located at Eduardo Acevedo 553 (Caballito), Commune 6; and San Martín Avenue 3253 (La Paternal), Commune 15. They were vents of the Buenos Aires main sewer system.

Hospitals, train stations, schools and the housing complex in the Parque Los Andes neighborhood, in Chacarita . Near the Chacarita cemetery is the Los Andes neighborhood, a group of collective housing that currently makes up Historic Protection Area 47. The Executive's proposal seeks to give it new structural protection, but individually, to each of the properties.

Among the properties with an asset value are also the buildings of the Juan A. Fernández public hospital and the Ricardo Gutiérrez Children's Hospital, both in Palermo; and the José María Ramos Mejía, in Balvanera.

The railway stations include Drago and Urquiza, which belong to the Mitre line-José León Suárez branch, and Saavedra of the Bartolomé Mitre branch; Villa Lugano of the General Belgrano train; Caballito and Liniers of the Sarmiento line, and Palermo and Villa del Parque of the San Martín line.

There are also several single-family homes built by prestigious architects located in different areas such as 24 de Noviembre 400, also in Balvanera.
